Theo kết quả điều tra, ngày 5-1-2025, trong quá trình xử lý phạm nhân vi phạm nội quy giam giữ, nhóm bị can trên đã có hành vi bạo lực đối với phạm nhân Phùng Thái C. Hậu quả, phạm nhân này tử vong sau đó.
Cơ quan Điều tra Viện KSND tối cao xác định hành vi của các bị can đã cấu thành tội “dùng nhục hình” theo khoản 4 điều 373 Bộ luật Hình sự.
Trước đó, phạm nhân C (36 tuổi, ngụ phường Vĩnh Thanh Vân, TP Rạch Giá, tỉnh Kiên Giang (cũ)) bị TAND huyện Hòn Đất phạt 2 năm tù về tội trộm cắp.
Tháng 8-2024, C bị chuyển từ nhà tạm giữ Công an huyện Hòn Đất đến trại tạm giam Công an tỉnh Kiên Giang.
Tối 5-1, C la lối, đá cửa buồng giam, tự đập đầu vào thanh sắt buồng giam làm chảy máu.
Sau đó C bị đưa lên phòng hỏi cung để làm việc. Tại đây, C tiếp tục quậy phá, la lối, dùng lời lẽ thô tục chửi cán bộ quản giáo, nên cán bộ (chưa xác định) dùng còng số 8 còng tay C vào khung sắt cửa sổ.
Đến khoảng 21h30, cán bộ quản giáo phát hiện C có biểu hiện mệt, khó thở, tay chân lạnh nên báo cáo ban lãnh đạo.
Ngay sau đó C được đưa vào Bệnh viện Đa khoa tỉnh Kiên Giang cấp cứu và điều trị. Đến 21 giờ 50 cùng ngày, bác sĩ khoa hồi sức cấp cứu thông báo C đã tử vong…
